SOLIDARITY CIVIL PACT

In Town Hall or at a Notary

The Civil Solidarity Pact (PACS) is a contract between two adults of the same or opposite sex to organize their life together.
The future partners must be pacser near the service of the Civil Registry of the town hall of their common residence.
Paced partners commit themselves to mutual aid and assistance.
In addition to the needs of everyday life, each partner remains responsible for the personal debts he has incurred before or during PACS.
You can choose the regime applicable to your property: either the legal regime of the separation of property or the undivided property. If you wish to establish a specific plan it is advisable to get closer to a notary.

Documents required :

• Cerfa form No. 15725 * 02 of joint declaration of a PACS, completed and signed by both partners,
• The PACS convention of the two partners (cerfa n ° 15726 * 02 or specific convention written by the partners),
• The identity documents of future partners,

For French nationals:

• An extract of birth certificate with filiation of each future partner of less than 3 months (or less than 6 months if the extract is issued by a foreign authority),
• If one of the partners is widowed: the family book of the old union where appears the mention of death or the copy of the death certificate of the deceased spouse,
• In the event of divorce or dissolution of a previous PACS, make sure that the mention is registered in the margin of the birth certificate, failing that, provide an extract of marriage with the mention of dissolution of these unions.

If one of the partners is a foreign national and born abroad:

Extract birth certificate with filiation of less than 6 months, if necessary translated by a sworn translator
The certificate of custom drawn up by the competent authorities or the diplomatic representation of the foreign country
The certificate of non-pacs of less than 3 months
If the partner resides in France for more than one year, a certificate of non-registration in the civil directory (RC) and a certificate of non-registration in the civil directory annex (RCA).

These attestations must be requested either with the teler service cerfa n ° 12819 * 05, or by e-mail at the central registry office: pacs.scec@diplomatie.gouv.fr, or by mail at the Central Office of the 'Civil status :

Refugees of OFPRA:

When a partner is a refugee, stateless person, or beneficiary of subsidiary protection, a non-PACS certificate dated less than 3 months old must be obtained using teleservice cerfa n ° 12819 * 04

The file is to be deposited 15 days before the registration date of the PACS with both partners, provided with the service at 04 94 55 69 00, either with the Population Service, or by mail to the City Hall, service Population BP A, 83316 GRIMAUD CEDEX

The PACS convention is returned to the partners, no copy is kept in Mairie.
